Spain is one of Europe’s most established second-home markets, and non-residents buy on the same terms as residents. We focus on the Costa del Sol, where branded developments and a deep international community support both the lifestyle and the investment case.

Can foreigners buy property in Spain?
Yes, on the same terms as Spanish citizens. You need a foreigner’s identity number (NIE) and a Spanish bank account, and your title is registered at the Land Registry like anyone else’s.
Read the ownership guideOwnership in your name
Non-residents own outright, with the same rights as residents. The purchase is signed before a notary and registered at the Registro de la Propiedad.
Deposits that are protected
Money paid to a developer before completion must be covered by a bank guarantee or insurance under Spanish law. We check it is in place before you pay.
No residency through property
Spain ended its golden visa for property buyers in April 2025. Buying no longer brings a residence permit.

Buying in Spain, from reservation to keys
In Spain the notary and the registry do much of the work, and you need a tax number before you start.
- 1
Get an NIE
A foreigner’s identity number and a Spanish bank account come first. Both are needed to sign and to pay.
- 2
Check the title
Your own lawyer checks the Land Registry entry, the building licence and any debts on the property before you reserve.
- 3
Sign the private contract
The contract fixes the price, the payment plan and the handover date. On an off-plan home, every payment is covered by a bank guarantee or insurance.
- 4
Sign before the notary
The deed (escritura) is signed before a notary and registered at the Registro de la Propiedad.
- 5
Pay the purchase taxes
On a new build in Andalucía, 10% VAT and 1.2% stamp duty; on a resale, a 7% transfer tax replaces both.
- 6
Let it, or use it
Holiday lets in Andalucía must be registered as a vivienda de uso turístico, and some areas now limit new licences. UK owners pay 24% on rental income.

Why choose Spain for property investment.

- 01
Demand from across Europe
Southern Spain draws buyers and tenants from across Europe and beyond. The Costa del Sol’s established international community supports both rental demand and resale.
- 02
Equal terms for international buyers
Non-residents hold the same ownership rights as Spanish residents, under a well-tested legal and notarial system. Spain’s links with Europe, Latin America and Africa add to its pull for international business.
- 03
Lifestyle with a financial case
Coastline, climate and connections make Spain a natural choice for second homes, retirement and relocation. We select the developments where that appeal also translates into rental income and resale depth.
Buying property in Spain: questions.
Can British people still buy property in Spain after Brexit?
Yes, on the same terms as Spanish citizens. What changed is how long you can stay: without a visa, up to 90 days in any 180.
What taxes do you pay when buying a new build in Spain?
On the Costa del Sol: 10% VAT and 1.2% stamp duty on a new build. On a resale, a 7% transfer tax replaces both. Add notary, registry and legal fees of roughly 2%.
Does buying property in Spain give residency?
Not any more. Spain closed its golden visa to new applications in April 2025. The non-lucrative and digital nomad visas are the usual routes now.
Is an off-plan deposit safe in Spain?
It should be. Spanish law requires deposits paid before completion to be backed by a bank guarantee or insurance. We confirm the guarantee before any money moves.
What tax do non-residents pay on rental income in Spain?
Non-resident income tax: 24% of the rental income for UK residents, 19% for EU residents, who can also deduct expenses.
