Can foreigners buy property in Malaysia?
Yes. Foreigners can buy freehold or leasehold property in their own name, with the consent of the state, above a minimum price that each state sets. Some property is reserved for Malaysians, and the rules differ from state to state.
Read the ownership guideTitle in your own name
Foreign buyers hold strata or landed title directly, once the State Authority consents under section 433B of the National Land Code. Your lawyer applies for consent after you sign.
Above the state minimum
Each state sets a minimum price for foreign buyers. In Kuala Lumpur it is RM1 million; Melaka, where we work, sets its own. The desk confirms the threshold for every unit we show you.
Reserved property
Malay reserve land, Bumiputera lots and low- and medium-cost housing cannot be sold to foreign buyers.

Buying in Malaysia, from reservation to keys
In Malaysia the state sets the floor: every foreign purchase clears a minimum price and needs the state’s consent.
- 1
Clear the state minimum
Each state sets a minimum price for foreign buyers; in Kuala Lumpur it is RM1 million. Bumiputera lots, Malay reserve land and low-cost housing are excluded.
- 2
Book and appoint a lawyer
A booking fee holds the unit, and your own Malaysian lawyer checks the developer’s licence and the project’s sales permit.
- 3
Sign the statutory agreement
New homes in Peninsular Malaysia are sold on the statutory form, with a delivery date and damages if the developer hands over late.
- 4
Apply for state consent
Your lawyer applies to the State Authority under the National Land Code. Foreign buyers pay a flat 4% stamp duty on the transfer.
- 5

Why choose Malaysia for property investment?

- 01
Between Kuala Lumpur and Singapore
Melaka sits between Kuala Lumpur and Singapore, on a southern corridor that is attracting serious capital. Johor’s growth as a data-centre hub has drawn investment from TikTok, Nvidia and Microsoft.
- 02
A broad, growing economy
Manufacturing, technology, tourism and services give Malaysia a broad economic base. That means rental demand from local professionals as well as international buyers and visitors.
- 03
Residency through MM2H
Malaysia My Second Home offers renewable long-term visas tied to deposit and property thresholds. Where residency is part of the plan, we structure the purchase to qualify.
Buying property in Malaysia: questions.
How do I invest in Malaysian real estate from the UK?
Buy in your own name, above the state minimum for foreigners, with state consent obtained by your own Malaysian lawyer. Typically that means a new-build or off-plan condominium in Kuala Lumpur or Melaka, protected by the statutory sale and purchase agreement. Budget for 4% stamp duty, legal fees and the state consent fee, and expect the rent to be taxed at 30% in Malaysia.
Is there a minimum price for foreigners buying in Malaysia?
Yes. Each state sets its own minimum price for foreign buyers. In Kuala Lumpur it is RM1 million. The threshold for Melaka is lower; the desk confirms it for every unit.
What stamp duty do foreigners pay in Malaysia?
Since 1 January 2024, foreign buyers pay a flat 4% stamp duty on the transfer, plus 0.5% on any Malaysian loan.
Does buying property in Malaysia give residency?
Not on its own. Malaysia My Second Home (MM2H) combines a fixed deposit with a property purchase above a set minimum, for a visa of five to twenty years depending on the tier.
What tax do I pay when I sell?
Real Property Gains Tax: 30% of the gain for a non-citizen selling within five years of buying, and 10% from the sixth year.
Can foreigners buy freehold property in Malaysia?
Yes, with state consent and above the state’s minimum price. Malay reserve land, Bumiputera lots and low- and medium-cost housing are excluded.
